[ARCHIVED] Citizens of Horseshoe Bay South

Recently a flyer has been passed out by Legacy Housing Corporation announcing the construction of a paved driveway connecting a development they are proposing named “Thanksgiving Mountain” to Highway 71.  They are offering residents access to utilize this driveway as an exclusive opportunity to receive access through their property on 26th Street that backs up to and runs through the Thanksgiving Mountain Development. 

The property that is between the property on 26th Street and the existing fence is privately owned and is designated as green belt. The owner of this property has not granted any access through this green belt property that is being claimed to be part of the driveway Legacy Housing Corporation is claiming to allow residents access through to Highway 71. 

Like your own property, Texas has laws in place to protect personal property rights from being encroached upon. The City respects all property rights and is sending this message to dispel this false pretense of Legacy having access or permission to do so legally, they do not.  

The City today received letters from both the original declarant/property owner and the Horseshoe Property Owners indicating that they have not and will not grant any permission to Legacy to trespass on their property. Therefore, to protect you from an issue of trespassing on private property we are sending this message to inform you of this issue in hopes of preventing anyone from trespassing.
